Service Description
ORKESTA provides a cloud-based digital signage platform that enables users to manage multimedia content on digital screens. The service includes: web dashboard access, playback device apps, media library, content scheduling, and remote monitoring. Specific features vary based on the subscribed plan.
Account and Registration
To use ORKESTA, you must create an account providing accurate and complete information. The user is responsible for the confidentiality of their credentials and all activities performed through their account. In case of unauthorized access, the user must immediately notify ORKESTA. We reserve the right to suspend or terminate accounts that violate these terms.
Billing and Payments
Paid plans are billed in advance on a monthly or annual basis. Prices are listed on the website and may be subject to changes with 30 days' notice. Payment is made via credit card or other accepted methods. In case of non-payment, we reserve the right to suspend the service after a 7-day grace period.
Cancellation and Withdrawal
The user may cancel their subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period. For annual plans, no refund is provided for the remaining period. Upon subscription end, content access will be maintained in read-only mode for 30 days, after which data will be deleted.
Intellectual Property
ORKESTA and its contents (software, design, trademarks, documentation) are the intellectual property of the company. The user retains ownership of content uploaded to the platform, granting ORKESTA a limited license to host and distribute such content to the user's screens.
Limitation of Liability
ORKESTA commits to guaranteeing a service uptime of 99.5% (99.9% for Enterprise plans). We are not liable for indirect damages, loss of profits, or interruptions caused by factors beyond our control. Maximum liability is limited to the amount paid by the user in the last 12 months.
AI-Generated Content
Part of the editorial content and of the illustrative images on this site was produced or reworked with generative artificial intelligence tools, always under the review and editorial responsibility of Sygnaptica. Images showing environments and installations are realistic renderings for illustrative purposes and not photographs of existing installations. Technical data, prices and contractual terms are checked by our team and remain the only binding elements. This statement addresses the transparency duties of Article 50 of Regulation (EU) 2024/1689 on artificial intelligence.
Modifications to Terms
We reserve the right to modify these terms with 30 days' notice via email or platform notification. Continued use of the service after notification constitutes acceptance of the new terms. For questions about the terms, contact us at [email protected].
Governing Law and Jurisdiction
The relationship is governed by Italian law. For disputes with users acting in the course of their business or profession, the Court of Padua has exclusive jurisdiction. If the user is a consumer within the meaning of Italian Legislative Decree 206/2005, the mandatory jurisdiction of the court of their place of residence or elected domicile applies, as does the right of withdrawal within fourteen days of entering into the contract, unless performance of the service has already started at their express request.
